On Friday 29/5/2020, MP Magda Al-Tamimi highlighted the second draft amendment to the retirement law and what was raised about it on social media sites, as she explained that the retirement law No. (26) for the year 2019 is the first amendment to the unified retirement law No. (9) of 2014. It was enacted hastily without extensive study to show its economic and social effects on state institutions in terms of loss of expertise and without giving sufficient time to prepare an alternative that will occupy the degree of assignments to retirement according to the legal path that set the road map for the employee’s career, which led to many problems that confused the lives of thousands of referrals to Suddenly forced retirement, as most of them entered into financial obligations of loans, advances and university installments for their children, in addition to losing them for years of their career, which greatly affected their pension salaries.


Al-Tamimi said in a statement that, “Because of the foregoing, Deputy Dr. Magda Al-Tamimi worked within a specialized work team that includes deputies, jurists, doctors, university professors, and experts to provide an amendment to the above law to amend the wrong paths to raise the injustice that forced employees to retire forcibly on the one hand and provide more job grades for unemployed youth On the job by developing legal articles that encourage the employee to retire after completing the age of (60) years.


Magda Al-Tamimi indicated “some paragraphs that would encourage the employee to retire upon the completion of the age of (60) years, as the end-of-service gratuity is spent for the employee who submits a request for referral to retirement within a period not exceeding (6) months after completing the age of (60) years and has a retirement service not Less than (25) twenty-five years and calculated on the basis of the full last salary and allocations multiplied by (12) and applies to cases from the date of (1/1/2020).


Al-Tamimi added that “employees who are referred to retirement are granted according to Article (1) of Law No. (26) for the year 2019 and those who complete the age of (60) years the following privileges:


1- Amortization (25%) of the total amount of the loan and advance received by them before the entry into force of this law, as well as extinguishing (50%) of the remaining amount of the benefits arising therefrom.


2- The deductions of advances and loans are transferred to the retirement salary, with a decrease in its percentage to no more than (15%) of the retirement salary.


3- Granting them an emergency grant of no less than (4) months of their last salary in the job, provided that they are repeated until the pension is spent and are later settled by deducting premiums from the end of service gratuity or from the pension in the event that the employee is not entitled to the bonus.


4- The fact that the employee is a guarantor does not prevent him from referring him to retirement without the condition that he finds a substitute for him.


Al-Tamimi stated that “he compensates employees who are referred to retirement under Article (1) of Law No. (26) for the year 2019 and those who complete the age of (60) years as follows:


1- Staff promotions are launched with diploma holders with all specializations up to the second degree.


2- The compulsory military service and the reserve spent before the job shall be counted for those covered by this law for the purposes of the bonus, promotion and retirement except for the Revolutionary Command Council Resolution (dissolved) No. (218) for the year 2002.


3- The difference between the employee’s age when referring to retirement is calculated according to the article of this law and article (1) of Law No. “26” for the year 2019 and the age of (63) years of work service for the purposes of bonus, promotion and retirement. This article applies to the grades (1, 2 and 3) ) From the payroll schedule attached to the state employees salaries law No. (22) for the year 2008 and in a manner that does not contradict the laws and regulations in force.


4- The employees who are housed when referring to retirement are granted grades (4 and below) from the salary scale attached to the State Employees Salaries Law No. (22) for the year 2008 for one job grade.


5- Retirement rights are calculated based on (the last salary), which is determined after calculating what is stipulated in this article, and the equivalent of calculating the pension for the period specified in item (third) of this article is an exception to Article (21 / Fifth) of the Unified Retirement Law No. (9) For the year 2014 as follows:

Retirement Salary = (Last Salary x 3.5x Number of Service Months / 12) / 100.



6- The employees covered by Article (4: First) of this law, who occupy a government role, will continue to live in it for a period of (6) months after receiving full retirement rights.


Al-Tamimi concluded, “These articles included in the amendment proposal encourage tens of thousands of employees to submit requests for referral to voluntary retirement in order to benefit from the privileges contained therein, which provides tens of thousands of job grades that we are working on by unemployed young graduates. And those with higher degrees and others.

Al-Halfi added, "The contract of employees of contracts and wages is one of the categories that must be paid attention to, since most of them are among the affected families who provided martyrs in the war on terrorism."

Al-Hilfi called on the Council of Ministers to “include a paragraph in the 2020 budget that includes fixing contracts and wages employees in all ministries to permanent owners after vacant job grades were available as a result of the owners’ movement due to the recent amendment of the retirement law. ”

"Economy News" publishes a  draft of a cabinet decision that will be taken during the next session regarding salaries and pensions, and this is the text of the draft decision.


First - salaries for senior positions



  • Reducing the total allocations received by the President of the Republic, the Prime Minister, the President of the House of Representatives, the President of the Judicial Council and the President of the Federal Court by 75%, provided that the total salary and allowances do not exceed 11 million dinars per month.



  • The total allocations received by the Vice-Presidents, Ministers, Parliament, Ministers, members of the House of Representatives, members of the Federal Court and members of the Federal Court of Cassation and those with a minister’s degree shall be reduced by 60%, provided that the total salary and allocations does not exceed 8 million dinars per month.



  • The total allocations for each of the ministries' representatives, consultants, all special grades, judges, general managers, and those in their rank shall be reduced by 555, provided that the highest salary and allocations for this category do not exceed 6 million dinars per month, including those working in the three presidencies.




Second: employee salaries


A - It does not include the civil and military employees affiliated with the paragraphs mentioned below, whose total monthly income is less than 500 thousand dinars of a nominal salary, allowances, and other different forms of income. As for those covered, the total salary of any of them after the reduction should not be less than 500 thousand dinars per month. .


B - The financing of the total allotments of different types that permanent staff members charge by 50% is only "other than the nominal salary" for employees whose total monthly income exceeds 500 thousand dinars in the centrally funded spending units, including workers in the three presidencies and that includes departments and self-funded companies who She receives a monthly grant from the Ministry of Finance and is an exception to all laws and decisions in effect in this regard. As for those whose total monthly income is less than 500 thousand dinars, they are funded by 100% of the allocations originally assessed.


T - The funding of the total allocations received by the military and members of the internal security forces in the Ministries of Defense and Interior, the Popular Mobilization Authority, the Frontier Ports Authority, the Anti-Terrorism Service, the National Intelligence and National Security Services, and the National Security Adviser will be 70%, while civil servants are covered by the second item of paragraph 15 of this decision And an exception from all laws and decisions in force in this regard.


Third: Salaries of public companies



  • The total allocations, incentives, profits and rewards that public employees and self-financed departments receive and that do not charge a monthly financial grant from the Ministry of Finance are reduced by 25%.



  • Subjecting the total salaries, allowances, incentives, profits and rewards that employees of public companies and self-funded departments that do not charge a monthly financial grant from the Ministry of Finance to are subject to income tax.




C - The share of the public treasury in the profits of public companies shall be 80%.
D- Cabinet Resolution No. 53 of 2020 shall be canceled.


Fourth: Subjecting pension salaries exceeding 500 thousand dinars per month to income tax, and that the financing of the highest pension is five million dinars per month, as of 1/6/2020.


Fifth: The deducted amounts in the items will be transferred as a final revenue to the public treasury for the purpose of filling the deficit in financing the social welfare network, medicines, ration card and other necessary expenses.

Member of the House of Representatives for the Legal Committee, Dr. Bahar Mahmoud, announced today, Wednesday 3/6/2020 that the work of the new pension age has affected many families, which necessitates the necessity of canceling it and returning to the old retirement age, calling for the inclusion of the retirement bill within the parliament’s agenda for this week.




Mahmoud said that reducing the retirement age from 63 to 60 according to Law 26 of 2019 should not be surprising in order to not harm employees and their families, pointing out that its implementation will be gradual because it is not possible to get three births from government institutions at once. She added that these births are at the pinnacle of scientific and professional giving, especially health and medical cadres, which the government needs them at this critical period, calling for the restoration of the retirement age to the original age of 63.




Mahmoud called for this law to be included in the parliament’s agenda for this week because of its importance, especially after at least 260,000 families were affected by it, noting that returning these babies to work cost them less than their retirement.




She noted that the purpose of the law in its time is to give young people the opportunity to be appointed to state institutions, but for the time being, with the prime minister forbidding appointment now, there is no wisdom in reducing the retirement age, let alone that it is something that might harm government institutions more than benefit them.

A statement issued by the media office of Al-Kaabi, received by Al-Iqtisad News, stated that the latter chaired an expanded meeting in the presence of the Chairman of the Finance Committee, Deputy Haitham al-Jubouri and members of the committee, and the Chairman of the National Retirement Authority Ahmed Abdel-Jalil al-Saadi, to discuss the problem of not completing the transactions of those retired under the recent amendment of the law The said end of last year.

Al-Kaabi called for the need to find a speedy and binding solution to end the suffering of this segment, stressing that priority should be given to the salaries of the retired population in general and not delaying their disbursement under any pretext in consideration of their circumstances and the general situation that requires redress for this segment that sacrificed its age to serve the country.

In turn, the Chairman of the Retirement Commission pledged to pay the end-of-service gratuity to new retirees, while the First Vice-President of the Council stressed the need to expedite the disbursement of those entitled to them starting from next month.

Also during the meeting, they discussed the most important problems related to pensioners ’salaries and the speedy completion of transactions, according to the statement.

The statement continued that it was decided during the meeting that the National Retirement Commission should find an urgent mechanism for disbursing a financial grant to each retired person who was referred to retirement at the beginning of the current year until the amendment of the retirement law or the completion of their transactions and the payment of their full financial dues. The Minister of Labor and Social Affairs, Al-Rikabi, announced that about 400 million workers in the Iraqi private sector are not subject to retirement and social security.

Al-Rikabi said in an interview with the official "Al-Sabah" newspaper, which was read by Al-Iqtisad News, that there are about four million Iraqi local workers working in the private sector that are not subject to the retirement and social security law, and that the required deductions were not made or the retirement pensions stipulated in the retirement and guarantee law were stipulated. Social wages, which is a guarantee for them.

He pointed out that retirement deductions are deposited in the Social Security Fund, which is a self-financing, as a guarantee for them upon referral to retirement and the service period reaching more than 15 years.

Al-Rikabi added that the ministry will soon start another campaign against local non-guaranteed workers from private sector companies who are not subject to the retirement and social security law because of the presence of collusion between the employer and employment and some of the ministry's employees.

Regarding making amendments to the Work Retirement Law, Al-Rikabi explained that the Ministry is working on forming a specialized committee to study the law, address gaps in it and make certain amendments to the law, noting that the ministry has set up a program to review all the laws of the ministry and the related bodies.

The Parliamentary Finance Committee confirmed, on Thursday, that the deducted money will be returned to retirees.

"The parliament issued a decision not to deduct any amount from salaries except for the three presidencies and special grades and for deputies and senior officials, and it is not permissible to deduct from employees, retirees and segments present in society with any amount," the committee's rapporteur, Ahmed Al-Saffar, said in a statement to government media.
 

Regarding the deductions that affected the retirees ’salaries, Al-Saffar explained that“ they will be returned to them, ”noting that“ even if all salaries, including the three presidencies, have been deducted, the deductions collected will not be sufficient to finance the deficit, so the issue is not partially resolved. ”

 Iraqi Prime Minister Mustafa Al-Kazemi announced on Thursday that the pension deductions were a financing process due to a lack of liquidity and included 27% of the pensioners, indicating that his government will return it within the coming days or with the salary of next month.

Al-Kazimi said in a press conference followed by "Al-Iqtisad News", that "we handed 73% of the retirees without prejudice to their salaries," adding that "the Iraqis inside the country deserve a lot and it is surprising that only the Iraqis abroad are compensated."

He continued, "The country relapsed and its economy deteriorated when it became a slave of oil," explaining that we "are suffering from poor planning and we do not have an economy."

Al-Kazimi pointed out that "the Iraqi economy is a lie and does not exist, but depends only on oil."

He pointed out that "the waste of public money is very wide, including the lack of control over the border crossings that some entities possess."

The government decided to deduct part of the salaries of employees and retirees to reduce the financial crisis caused by the drop in oil prices due to the Corona pandemic.

In accordance with the directives of the Prime Minister, the National Retirement Authority, in cooperation with banks and electronic payment companies, has returned the deducted amounts by 99% of retirees, "the authority said in a statement.

She added, "A few remain, and the deductions with the salary of next month will be automatically returned to the electronic computer system. This does not require citizens to review the National Retirement Life Bureau or its branches in the governorates."

She continued, "For the purpose of reducing the review due to the Corona pandemic, please update the retired data through smartphones."

The Minister of Labor and Social Affairs, Adel Al-Rikabi, called for amending the retirement and social security law to raise the level of the working class in Iraq, while directing the Retirement and Social Security Department to submit proposals for amendment to the law within 15 days.

The Minister said during a meeting chaired yesterday, Monday, in the presence of the Director General of the Retirement and Social Security Department for Workers and the Federation of Trade Unions in Iraq and the president and members of the General Retirement Authority in a statement seen by "The Economy News", "There is a government request to indicate the Ministry's opinion regarding the progress of the Social Insurance Law or Amendments to the Workers' Retirement and Social Security Law.

He added, "There are many problems in the public retirement law, as well as the case with the private sector," noting that "merging the retirement and guarantee funds without addressing these problems may create a new crisis and work must be done to address the legal foundations in both laws and postpone the issue of merging the two funds to another time". 

The Minister stated, according to the statement, that "the Social Insurance Law needs further amendment and extensive study because the combination of the two funds needs to unify all the provisions and privileges granted to employees in the government sector and workers in the private sector to ensure that no injustice or injustice is brought to an entity."

He pointed out that "the retirement and social security law, despite the gaps in it, but it is the closest currently to dealing with workers' issues, and the ministry is proceeding with making amendments to the law in line with the rights of the working class." 

The Minister directed the "Department of Retirement and Social Security to submit proposals for amendment to the law within 15 days and held another meeting in the presence of the General Secretariat of the Council of Ministers to explain the opinion on the amendments or the draft law amended in advance and was reviewed by both the State Consultative Council and the Council of Ministers in order to achieve the desired goal to encourage the private sector and reduce the burden The government sector in employment. "

The head of the authority, Iyad al-Jubouri, said in a statement reported by the official news agency "INA" and reviewed by "Al-Iqtisad News", that "the statistics of the transactions of employees who were referred to retirement according to the new retirement law were in the range of 60 to 62 thousand transactions, and what was accomplished by the retirement department and all its branches." About 52 to 54 thousand transactions, and the remaining 8 to 9 thousand are still being completed. "

He added that "the retirement department and all its branches complete between two and three thousand transactions per week."

He stressed that "all the salaries and financial benefits of retirees are fully insured, and there are no obstacles facing us in the fulfillment of pension rights."
