The Cabinet held its regular weekly meeting in Baghdad on Tuesday under the
chairmanship of Prime Minister Adil Abd Al-Mahdi.


The Cabinet discussed a number of issues on its agenda, including the resignation of the
Minister of Health, Dr. Ala Alwan. The Cabinet stressed the need to provide the right environment for his return and for the the success of all ministries.


The Cabinet approved the draft Construction Council bill and forwarded it to the Council of Representatives.

Reconstruction Council
Chapter One
Definitions and foundation
Article 1 The terminology of this law shall have the following meanings:
First: The Council: The Amar Council.
Secondly Amar Council. Chairman of the Board: Chairman
Third: Executive Director: The Executive Director of Al Amar Council. :
Four Projects: Major development projects and infrastructure financed by the Council's percentage:
Of the revenues included in the general budget or from the private sector, or both, which increase its cost
It is estimated at (250) two hundred and fifty billion dinars or any other projects referred by the Council of Ministers to
the Council .
Fifth: Investment Law: Investment Law No. (13) for the year 2006 and its amendments.

Article (2) A law shall be established by virtue of this law called the Amar Council, which shall enjoy the moral personality
Financial and administrative independence shall be represented by the Chairman of the Council or his authorized representative.
Chapter II
Objectives of the Council
Article 3 - The Council aims to:
First: Preparing, designing, implementing, facilitating, managing and supervising the Council's projects, setting its priorities and contracting
They shall be referred to implementation and operation directly or in coordination with the federal ministries, regions and governorates
Not organized in the territory.
Second: Increasing the growth rates of GDP and national income and raising the standard of living of citizens
Third: Creating job opportunities and developing the skills of Iraqi workers in the council's projects and their input:
And their outputs.
Fourth: Encourage the provision of basic services to citizens and maximize the benefit of Iraqi citizens from revenues
Country.
Fifth: Increasing rates of direct and indirect foreign investment in Iraq.
Sixth: The development and diversification of Iraq's resources and the exploitation of its wealth and human resources in an ideal way.
Seventh: Contributing to the reform of the financial, industrial and commercial institutions and sectors of the State.
Eighth: Develop national policies for reconstruction and investment with the approval of the Council of Ministers.
Ninth: Involve the Iraqi and foreign private and mixed sectors in the implementation of the projects covered by this law.
Chapter III
Board Formations

Second: The Prime Minister shall nominate the following:
The functions of the Council to fill the position of Executive Director of the Council and appointed with the approval of the Council of Ministers with the rank of minister
A presidential decree is issued for appointment.
Third: The members provided for in paragraph (g) of item (I) of this Article shall be selected

Building
The nomination of the Prime Minister and the approval of the Council of Ministers.
Fourth: Members of the Board are not required to be full-time except for the Executive Director.

Fifth: The member of the Council stipulated in paragraph (g) of item (first) of this article
Monthly remuneration determined by the Chairman of the Board.

Seventh: The membership of the members provided for in paragraph (g) of item (I) of this Article shall be regulated
According to the following provisions:


(A) The Council of Ministers shall, in the first year of its formation, issue a regulation setting out the conditions
The criteria for differentiation and the mechanisms to be applied for the selection of members, and the Council of Ministers procedure
The amendments are then proposed by the Board.
(B) The term of membership shall be limited to two (2) years, and shall be made in the first installment of the members upon establishment

(D) The Chairman of the Board may exempt any member before the expiry of his term of office in case of breach of his duties.

Article 5 - The Vice-Chairman of the Council shall replace the President in his absence.
First: The Board shall meet at least once a month at the invitation of the President or his deputy to authorize Article 6.

Second: The sessions of the Council shall be held in the presence of an absolute majority of the number of its members, provided that the Chairman shall include:
Council or his deputy.
Third: The decisions and recommendations of the Council shall be taken by a majority of the votes of those present, including the Chairperson of the session

Functions of the Council
Article (7) The Board shall perform the following tasks:

First: Negotiation and contracting in accordance with the principles of competition, transparency, sobriety, justice and achieving the highest profit value
Or developmental, with Iraqi or foreign entities to achieve its objectives including contracting with international organizations

Relevant legislation governing the contracting of government entities.
Second: With regard to the Council's projects, the development of regulations, policies, plans, specifications and programs:
Decisions that the ministries, departments and the private sector are obliged to implement.
Approval of plans, implementation, modification, financing and operation.
Third
Four Financing or Guarantees Financing or financial facilities for the projects covered by its provisions in coordination with:
Iraqi and foreign financial institutions.
Fifth: Approving the financing or guaranteeing the financing of the Council's projects against a sovereign guarantee with the approval of the Council
Ministers.
Sixth: Institutions inside and outside Iraq to buy and lease movable funds: Contract with companies
Immovable to achieve its purposes.
Seventh: Supervision, control and follow-up of all the projects of the Council.
Eighth: Any other powers vested in the Council of Ministers, ministries or entities not affiliated with a Ministry or:
Regions or governorates that are not organized in a region and accepted by the Council.
Article 8 The Board has the authority, functions and competence of the National Investment Commission stipulated in
Investment Law No. (13) of 2006 with respect to the Council's projects, including granting the license

Article 9 The meetings of the Council shall be held in private. The President of the meeting may decide to make the meeting public
Article 10 The Council shall adopt the following means to achieve its objectives:
First: Establishment, development and follow-up of the Council's projects.
Second: Studying and financing the projects of the Council and approving their referral to the executing authorities, or operating them
And contract it.
Third: Establishment, investment, participation and partnership in private, mixed and public companies including
. Holding companies, funds, banks or projects
In kind or in cash
Fourth: Selling the share and dividends to achieve its objectives, provided that priority shall be given to transferring ownership of the shares of the projects of the Board.
To Iraqi citizens when writing, issuing, or transferring ownership.

Article 11
First: The Council shall coordinate with sectoral ministries and other relevant authorities on the development and implementation

Article 12 The Council shall submit annual reports to the executive and legislative authorities including:

Third: Extraordinary at the request of one of the legislative authorities or any other periodic reports;

Second: The executive branch consists of the following formations:
Office of the Executive Director.
B - Office of Studies and Strategic Planning
C. Investment and Finance Office.
D. Legal, administrative and financial office.
Project Management Office.
Promotion and Project Services Office.
G - Department of Public Relations and the world.
H) Internal Control and Audit Section.
Third: This office shall be administered by a third party manager:
High experience and competence with international standards and proficiency in one of the living languages ​​and preferably the holder of the degree
A postgraduate degree in the field of office competence.
Article 14: The executive body shall, within the limits of the Council's projects, undertake the following tasks:
First: Propose, prepare, develop and elaborate annual plans, projects, programs and financing methods
Projects and appropriate implementation mechanisms on the basis of their economic or developmental returns, or both.
Secondly, oversight, supervision and follow-up to the success of projects approved by the Board.

Third: Identify and propose the Council's projects suitable for its objectives and determine the priorities of these projects within the scope of:
Infrastructure projects or utility services include but are not limited to:
A. Housing projects
(B) Major industrial projects or in which the private sector is not allowed
Like military industries
C - Transport projects such as ports, airports, railways, river and maritime transport and networks
Roads and tunnels for thousands of people, goods and metro.
D. Development and implementation of new cities.
E - Development and implementation of industrial cities.
(F) Energy production, transmission and distribution facilities.
(G) Medical and educational cities.
(H) Water channels and dams.
(I) Soil reclamation, land cultivation and irrigation networks.
J. Telecommunication services, systems and wired and wireless networks.
K - Tourism projects related to the maintenance of monuments and the establishment of tourist cities.
Large stadiums and infrastructure for sports facilities.
Fourth: Preparation and preparation of designs, feasibility studies, cost calculation and preparation of proposals for projects.
Hire experts and consultants to achieve the best results, reduce costs and avoid challenges.
Fifth: covered by the investment budget of the Council and determine its costs and submitted to the Council: Identification of projects

Article 15 The Executive Director shall perform the following tasks:
First: Managing the Council's financial and administrative affairs.

The formation of specialized committees in the fields of work of the Council.

Forming investigative committees and special committees and endorsing their recommendations.

Sixth: Sign any contracts authorized by the Council.
Seventh: Inviting them to attend the meetings according to: contracting with the Iraqi and foreign consultative bodies

Eighth banks approved by the Central Bank of Iraq inside and outside Iraq. Opening accounts with:
Ninth: Exercise any other functions related to the work of the Council. :
Chapter V
Financial rulers
Article 16: The sources of financing of the Council shall be the following:
First: Financial allocations from the annual federal general budget to cover operating expenses.


Second: 5% five percent of the total revenues included in the annual federal budget
To finance the projects of the Council after deducting the necessary expenses payable.
Third: The allocations of the projects of ministries and entities not associated with the Ministry, regions and governorates
In the territory of the Council which are part of the Council's projects in accordance with the provisions of this law.
4. Profits, fees and charges for services provided by the Board to others. :
Fifth: Funds allocated to the Council stipulated in the legislation in force or deposited in
Special funds according to the law.
VI Any other resources accepted by the Council.
Article 17
First: The accounts of the Board and its formations shall be subject to the control and audit of the Financial Control Bureau in accordance with a law
The Council and the regulations and instructions issued by it.
Second: The Council may use international accounting and auditing companies to audit its accounts and performance.
Article 18 The Council shall approve the annual budget of the Council and the final accounts.
Article (19): The profits from the projects of the Council shall be distributed to the Iraqi citizens according to

Chapter six
General Referees
Article 20
First: The Board shall formulate proposals proposed by the Executive Director containing specific rules
Placement of employees according to their tasks and determining the necessary periods to accomplish these tasks.


Secondly, all its employees (employees or contractors) are provisional: the obligations of the Board are directional
The Board shall not have a permanent functional owner.
Article 21
First: The Board may assign employees from any ministry or entity not affiliated with a ministry to work in the Council.
The period of work in the Board shall be calculated for the purposes of premium, promotion and retirement.
Second: Issued by the Council: The rights and duties of state employees who are affiliated to work in the Council shall be subject to a regulation
Exemption from public employment laws.
Third: The Board shall, upon the proposal of the Executive Director, determine the job description for all locations therein and the conditions

Annual maintenance of the site.
Fourth: The Board shall issue a proposal by the Executive Director of the document of professional conduct, working conditions and regulations:

Article 22 The Council may request the Council of Ministers to allocate land for its projects, including the transfer

Article -23 - Ministries and entities not associated with the Ministry and the provinces and provinces not organized in

Article -24 - The Council may issue approvals and permits of various types and purposes, and ratify

Article 29
First: In September of each year, the Board shall submit the plan of projects and programs prepared for the year

Final Provisions
Article 30 The Executive Director may create, cancel or merge the administrative formations of the Board and prepare its owner

Article 31 The law of the Amar Council and the Ministry of Architecture No. 27 of 1953 shall be repealed.
Article 32 The Council may issue regulations and instructions to facilitate the implementation of the provisions of this law.
Article 33 No provisions of this law shall be applicable.
Article 34 This law shall be enforced from the date of its publication in the Official Gazette.
Reasons
In order to execute major projects effectively and well planned, manage, supervise and operate, and create jobs,
Developing the skills of workers and maximizing the utilization of state resources by Iraqi citizens through distribution
Profit on projects and give them priority by subscribing to the projects of the Council, and the implementation of related development projects
The economic importance of developing and diversifying Iraq's material and human resources and establishing capable national active sectors
To promote free competition and promote development by establishing infrastructure and services and establishing projects

Establishing airports and others, and strengthening efforts to make the Iraqi and foreign private sector a key financier
For projects without total dependence on the state investment budget, and for the establishment of an integrated council
