The Secretary-General of the House of Representatives, Mr. Sirwan Abdullah Sereni visited the Kurdistan Region Representative in Baghdad, where he met Mr. Fares Issa, head of the Representative.

At the beginning of the meeting, the Secretary-General presented his congratulations and congratulations on the occasion of the accession of Mr. Fares Issa as Head of the Representative, wishing him success and success in the tasks entrusted to him.

In turn, the Head of Mission welcomed the Secretary-General, commending his visit and congratulating him.

I want to share with you my experiences from Baghdad, where I spent three days meeting public figures and lawmakers with a Rudaw team. 
 
They told me that the Kurdistan Coalition at Iraqi parliament only exists as far as the sign hanging on the part of the building where the Kurdistan Democratic Party (KDP) and the Patriotic Union of Kurdistan (PUK) lawmakers stay. Kurdish blocs do not have coordination or a unified position, but this does not mean that there is animosity between them. Rather, there is a sort of uncertainty among them.

They told me that there are several sensitive and sometimes decisive issues which require us to work together as a Kurdistani team in Baghdad, against two big Sunni and Shiite contingents. An ununified Kurdish position will hinder our ability to counter threats to our share of the 2020 budget.

Iraqi finance minister Fuad Hussein, a Kurd, was appointed by KDP leader Masoud Barzani. Kurdish and Arab lawmakers as well as the parliament presidency complain about his attitudes and behavior. One positive thing I heard about him was that he has said he would not do anything illegal for anyone. Rejecting and eradicating illegality is a virtue. 

However, what has mainly angered parliamentarians is his rejection of requests for answers. This has been the pretext for which lawmakers have twice summoned him to parliament - but the parliament presidency have taken this pretext out of the meeting agendas. If summoned, he could be probed, and a call for no-confidence vote could be initiated. It would be a low point in Kurdish history to have the tenure of two Kurdish finance ministers ending on a no-confidence vote in Iraq (the first one being Hoshyar Zebari).
 
In formal meetings, Baghdad has said that Kurdistan Region’s political future is oriented towards Baghdad. They have sensed that Erbil-Baghdad relations are improving, and that Erbil wants to have as few issues possible with Baghdad.
 
The hot topic in Baghdad is the handover of 250,000 barrels of oil per day to Iraq, as accepted by Kurdistan Region and stipulated in 2019 budget law - but the problem is that there could be demands for the increase of this amount.
 
A circulating rumor is that some Kurdish lawmakers once met with Iraqi Prime Minister Adil Abdul-Mahdi and talked about this amount of oil. The Iraqi Oil Minister then joined the discussion, saying that 250,000 bpd is not enough and that Kurdistan Region should hand over more of the 650,000 bpd it produces. However, Abdul-Mahdi replied that the budget law stipulates that the Kurdistan Region should be allowed to pay its debts to companies, something it may be incapable of doing if it hands over more than 250,000 bpd.
 
Some people are not tolerating the decision and have already begun efforts to increase the 250,000 bpd, lobbying for its increase in 2020 budget law. Additionally, Abdul-Mahdi’s lenience and compromise towards Kurds may end in the face of pressure from other parties. 
 
Baghdad is not like Erbil because partisan agreements are not directly implemented and require lawmaker approval. There, agreements are turned into bills and taken to the parliament, but MPs may not do what their political parties tell them to do. When one lobbies with or tries to convince political leaders of parties to vote for a bill, they have to do the same with parliament and lawmakers. 
 
There is a great vulnerabilty in Baghdad for Kurds, who do not have an umbrella to gather under. PUK leader Jalal Talabani used to be in Baghdad as the President of Iraq. Everyone depended on him. He also had direct contact with Masoud Barzani, then President of Kurdistan Region. Sometimes, he made decisions on behalf of Barzani as his representative in Baghdad. However, now Kurds do not know who to deal with. 
 
Formal communication should be in place between the President of Iraq and President of Kurdistan - currently, between Barham Salih and Nechirvan Barzani. They can fully coordinate and agree on treating Salih as Nechirvan Barzani’s representative in Baghdad. Additionally, Masoud Barzani should also support such an agreement. I believe this arrangement will be approved of by other parties too.

The Kurdistan Regional Council of Ministers decided on Wednesday to form a committee to follow up talks with Baghdad to find a mechanism in the implementation of the Federal Supreme Court's decision on Article 140 of the Constitution. 


The Information Office of the Prime Minister of Kurdistan, in a statement received (Mawazine News) a copy, that "the Council of Ministers of the Kurdistan Region, held under the chairmanship of President Masroor Barzani, its regular session." 


The statement added, "The Council, at the beginning of its meeting referred to the decision of the Federal Supreme Court No. (71/2009) issued on 28/7/2019 to remain in force Article 140 of the Constitution, and then decided to form a committee of the Council of Ministers in coordination with The General Commission for the Kurdistan regions outside the administration of the region to follow up talks with Baghdad to find a mechanism in the implementation of Article 140 under the decision of the Federal Court.


He pointed out that "the meeting, discussed the appropriate mechanism for the implementation of the eighth paragraph of the reform section of the government program, and the reform of the tax system in a way that ensures justice in taxation and prevent tax evasion." 


The Council of Ministers stressed the importance of taxes, stressing the need for all individuals, entities and companies to pay their debts and taxes to the government. 


He pointed out, "the importance of unifying the internal tax fees from the legal and administrative terms in a manner that takes into account justice, and takes into account the level of income when imposing taxes." 


He decided to "revise the lists of the names of the disabled and the handicapped," and voted on "re-pay the salaries of about 13 thousand of the beneficiaries of the handicapped and disabled."

The Kurdistan Democratic Party bloc on Saturday, demanded the government to apply Article 140, pointing out that the article in force and constitutional application.


"The Federal Court has decided that Article 140 is in force and is still in place," Sabri told The Glamish Press, stressing the need for "the government to implement Article 140 because it is constitutional and binding within Iraqi legislation."


She pointed out that "there is a committee in the Council of Ministers called the Article 140 Committee and its activation is very important in addition to the parliamentary committee, which came within the rules of procedure of the House of Representatives," stressing that "the Federal Court confirmed that Article 140 is valid and did not end."


She added that "there is a high committee between the government and the region to resolve the outstanding problems between the parties and they are discussing all outstanding issues, including Article 140."


Article 140 of the Iraqi Constitution provides for a three-stage mechanism: the first is normalization, which means addressing the changes in the demographics of Kirkuk and the 'disputed' areas during and after the former regime, and the second census in those areas, the last referendum to determine what its population wants. A delegation from Erbil will go to Baghdad after the Eid al-Adha holiday to discuss the application of Article 140 of the Constitution.

"After Eid al-Adha holiday, a delegation from the Kurdistan Regional Government will goto Baghdad and discuss with the Iraqi government the application of Article 140 of the constitution, " Mullah Nasser Ahmed told Pasnius .

He added «the Iraqi government can not control the Kurdish areas (disputed) without the Peshmerga, where the deteriorating security situation in these areas day after day».

Nasser said that Baghdad was the initiative to agree on the application of Article 140, and said: «This is a good step to reach an agreement between Erbil and Baghdad».

The Minister of Peshmerga in the Kurdistan Regional Government Shoresh Ismail has confirmed the first day of Eid al-Adha, that there are dialogues with the Iraqi army in order to return the Peshmerga to 'disputed' and fill that security gap existing.

The parliamentary Finance Committee, on Tuesday, that the budget next year will not pass unless it is agreed between Baghdad and Erbil on its items, indicating that there is a scientific study by the Ministry of Oil and specialized advisors in order to determine the price of a barrel of oil to be calculated by the 2019 budget.

He pointed out that "a number of questions are being asked about the ruling of the Federal Supreme Court on this article and the first timing of the issuance of this ruling, and why the judicial decision coincided with the political movement between the federal government and the Kurdistan region."

Al-Sharif said, "The court did not issue its verdict on its own, but this came upon an explanatory request received from the House of Representatives dated (15/7/2019), and therefore became necessary for the judiciary to decide." 

He continued, "The timing must be asked by the interpreter, although the right of access to justice is guaranteed to everyone in accordance with Article (19 / III) of the Constitution, and at any time." 

He added, "The court issued its interpretative judgment a few days after receiving the request after it completed its study of all formal and substantive aspects with a view to issuing the verdict in it, on (28/7/2019)." 

He stressed that "when the court issued the verdict was in accordance with Article (92 / second) of the Constitution, in accordance with its interpretative jurisdiction, which ruled in many judgments, including on (the age of the electoral cycle and the largest parliamentary bloc and the opposition bloc and the unity of Iraq and territorial integrity)." .

Sharif stressed that "the omission of an article in the Constitution means that we are making an amendment to it, and this amendment can be obtained only through the mechanisms provided for in the Constitution itself."

He pointed out that "the constitutional legislator, if he wanted to exclude article (140) of the Constitution from the rules of amendment of the Constitution stipulated in its articles, to mention it explicitly, as his intention was clear that that period was designed to oblige the executive authority to a certain task, and that skipping it will make it vulnerable For accounting. " 

Al-Sharif stated, "The position of the Federal Supreme Court on this matter is not the first of its kind, but it went in the same position in the interpretation of Article (142) of the Constitution by virtue of the number (54 / Federal / 2017) issued on 21/5/2017 on the mechanisms of amendment the Constitution". 

He continued, "Article 142, which is also included in the transitional provisions and provides for time limits for amendments, but the court said in its interpretative ruling that that article is still valid as well."

He added, "The same position with regard to Article (137) of the Constitution, which talked about the formation of the Council of the Union (the second wing of the legislative authority), after the end of the first electoral cycle for the years (2006-2010), but the Federal Supreme Court ruled in many of its judgments This council, even though we are in the fourth electoral cycle now. "

BAGHDAD — Meetings last month between representatives of Iraq's federal government in Baghdad and the Kurdistan Regional Government (KRG) in Erbil failed to produce any clear resolutions of their ongoing differences.

A high-level delegation from the Baghdad government visited Erbil on July 25 for talks with the newly elected government there. Discussions focused on KRG oil exports, its share of the federal budget and control of disputed, oil-rich Kirkuk. The Baghdad representatives included Oil Minister Thamer Ghadhban and Finance Minister Fouad Hussein, national security adviser Faleh al-Fayadh and the director of the prime minister's office, Mohammed al-Hashemi.

Masrour Barzani had begun his tenure as KRG prime minister by leading a senior Kurdish delegation on a visit to Baghdad on July 16, less than a week after the KRG Cabinet received a parliamentary vote of confidence. Barzani met with President Barham Salih and various ministers and parliament deputies to discuss various potential solutions to their disagreements that would satisfy all sides, especially with regard to the KRG’s inability to fulfill its oil quota under the current year’s budget. The KRG is obliged to provide 250,000 barrels a day to the federal government in return for Baghdad funding KRG employee salaries.

“The federal government praises the spirit of cooperation and understanding with the KRG and local governments to promote integration and solve all problems for the benefit of all Iraqis in line with the Constitution and the unity of our people and our country,” Iraqi Prime Minister Adel Abdul Mahdi said in a statement after meeting with Barzani.



As with KRG President Nechirvan Barzani’s visit to Baghdad in June, the July visits did not yield tangible results. Still, the meetings reflect the Kurds' desire to settle their situation with the central government after the tensions and conflict generated by the 2017 independence referendum in Iraqi Kurdistan.
The visits also revealed the difficulties Abdul Mahdi, known for his good relations with the Kurds, is having in implementing decisions that would be favorable for the KRG due to the conflicting interests of the political blocs in his government. For example, the Iran-backed Fatah bloc refuses to oust the Iran-friendly Popular Mobilization Units (PMU) from the city of Kirkuk, as the KRG desires, so they can be replaced with Kurdish peshmerga. Other blocs from the central and southern provinces object to releasing the KRG from its oil obligations under the federal budget law. They believe this would be unfair to other oil-producing provinces, such as Basra and Maysan, since the Kurds do not share their oil or oil revenues with the rest of the country. Baghdad capitulating on the oil-for-salaries arrangement would lead to some parties raising objections and complicating passage of the next budget law.
The most important outcome of the meetings between Baghdad and Erbil was the announcement of upcoming technical dialogue sessions, at the level of specialized committees, aimed at continuing to try to resolve their differences on the oil exports, the budget and Kirkuk. Haneen al-Qaddu, a member of parliament from Fatah, told Al-Monitor that he does not expect the technical committees to suggest a solution that circumvents the oil-for-salaries structure. He asserted that next year's budget will not include federal payments to the KRG unless Erbil settles its oil dues for 2019.
Parliament member Mahdi Abdul Karim from the Kurdistan Democratic Party (KDP) asserted that resolving this particular issue requires examining the relationship between Baghdad and Erbil for the past decade and considering why, in his and some others' view, the KRG had begun exporting oil directly, without coordinating with the federal government, a move that greatly angered Baghdad.
“The KRG did not get its due share of the budget over the past years, so it had to search for other sources of funding,” Abdul Karim argued, seeming to absolve the KRG and stressing the need to promulgate the oil and gas law based on the Iraqi Constitution to avoid controversy over oil extraction and export in the productive provinces. 
Al-Monitor learned from a source familiar with Barzani’s talks in Baghdad that the topic of filling the post of Kirkuk governor was raised in talks. The office has been headed by a caretaker since 2017, when in the aftermath of the independence referendum, Baghdad dispatched the military to seize Kirkuk and remove the separatist governor.
“KDP leader Massoud Barzani [Masrour's father] had proposed appointing a governor in an agreement between Baghdad and Erbil to resolve the dispute between the constituent blocs of the Kirkuk Provincial Council,” the source told Al-Monitor. In the meantime, the Kurdish blocs in the Kurdistan parliament agreed to name Tayeb Jabbar to the post on July 11, as part of a deal to form the KRG Cabinet, subject to the approval of the Arab and Kurdish blocs in Kirkuk province. The other blocs rejected Jabbar and said the Kurdish blocs’ agreement “reflected a policy of hegemony and unilateral decision making.”
According to the source, the parties Barzani met with in Baghdad promised to discuss the nomination of a new Kirkuk governor with the Turkmen and Arab blocs and parties in the province. The blocs, however, are convinced that the discussions will renew tensions in the disputed area and that the best option is to wait for local elections, scheduled for early next year. Meanwhile, Barzani wants to appoint a Kurd close to his party to lead administer Kirkuk.
Erbil has a new trump card that it could probably use in the negotiations on oil and Kirkuk: special grades positions, estimated at 5,000 jobs in the Iraqi state. It is rumored that discussions are being held among the federal parliament blocs to allocate certain positions according to a quota system. According to leaks, Kurdish blocs wan to appoint the chief of staff of the Iraqi army, but might compromise on some other positions in return for oil-related exemptions or Kurdish influence in Kirkuk.
If the crisis between Baghdad and Erbil surges after the 2019 budget law is approved, it will most likely lead the Kurds to withdraw their support for Abdul Mahdi. Meanwhile, the prime minister’s government faces parliamentary opposition and ongoing popular protests that are expected to broaden in light of its continuing failures in the areas of security, reconstruction and water and electric services.

ERBIL (Kurdistan 24) – Iraq’s Interior Minister Yassin al-Yasiri arrived in Erbil on Wednesday evening, spearheading a high-level government delegation set to meet with his Kurdistan Region counterpart.
The trip marks Yasiri’s first visit to the autonomous Kurdish region since he formally took office in Prime Minister Adil Abdul Mahdi’s government in late June.
The Kurdistan Region’s Interior Minister, Rebar Ahmad, along with other ministry officials, received Yasiri and his accompanying delegation at Erbil International Airport late in the day.


Yasiri’s delegation included officials in the federal government, directorates of nationality, passports, and borders, and airport and traffic security.

After their arrival, Iraqi Interior Ministry spokesperson Saad Maan told reporters that one of the topics that would be explored is “security cooperation,” among others. Maan also said the Kurdish and Iraqi ministries would discuss the state of the country’s borders, specifically with Syria.
The two sides will hold further talks on Thursday.
One unresolved issue is the Iraqi government’s approval of the formalization of many border crossings with Iran, which has already agreed to it from their side. Border officials from Baghdad are among the Iraqi delegation, which suggests this might be a topic of discussion.
Over the past few months, the new Kurdistan Regional Government (KRG) cabinet has had several delegation visits and exchanges with the Federal Government of Iraq to find solutions to long-standing issues between the two sides within the framework of the Iraqi Constitution.
Ties between Erbil and Baghdad have significantly improved after being strained over the past few years following the Kurdistan Region’s historic independence referendum, which saw a landslide majority favor statehood.

The Ministry of Interior announced on Thursday that its Minister Yassin al-Yasiri had agreed to cancel the entry fee for the Kurdistan region of Iraq.

ERBIL (Kurdistan 24) – The United Kingdom wants the Kurdistan Region to continue to be a strong and stable partner in the Middle East, a British official said on Monday.
James Thornton, the British Consul General in Erbil, made the comments in a meeting with Masoud Barzani, the President of the Kurdistan Democratic Party (KDP). Thornton met with the Kurdish leader to introduce himself as the new Consul General in Erbil.
The British official “expressed his satisfaction with the progress of the political process in the Kurdistan Region and the start of the new government, stressing that his country wishes the Kurdistan Region to be strong and stable,” a statement on the KDP leader’s website read.
Thornton also “wished to develop further relations between Britain and the Kurdistan Region,” it added.






Both sides also discussed the latest political developments in Iraq and the region, in general, especially as the so-called Islamic State threatens to reemerge.
One of the areas of discussion was Article 140 of the Iraqi Constitution and the security situation in Kirkuk, a province disputed between the Kurdistan Regional Government (KRG) and the Federal Government of Iraq.
Article 140 is related to the status of disputed areas between Baghdad and Erbil. According to the article, a referendum was supposed to be held in these areas to determine if its residents want to be governed by the KRG or Iraq. However, no such vote has taken place yet.
Delegations from the Kurdistan Region and Iraq have met regularly in the last few months to resolve outstanding disputes, including those related to the contested areas.
“Relations between the Kurdistan Region and Britain were another focus of the meeting,” the statement concluded.

ERBIL — The Kurdistan Regional Government (KRG) is determined to continued its talks with the federal government of Iraq in hopes of an agreement that will secure the constitutional rights of the people of Kurdistan Region, said Prime Minister Masrour Barzani.
The Kurdish top official discussed the Erbil-Baghdad ties in a meeting with Jeanine Hennis-Plasschaert, the Special Representative of the United Nations Secretary-General for Iraq, on Monday.
Reviewing the current situation of the Iraqi internally displaced persons (IDP) in Kurdistan Region, PM Barzani noted that Erbil has spared no efforts in providing the IDPs with assistance despite the economic challenges the KRG has been struggling with.
On Kirkuk and the prolonged disputes, PM Barzani and the UN envoy agreed that the situation in the contested territories should be normalised while the implementation of Article 140 of the Iraqi Constitution remains a requisite to fundamentally address the issues.

ERBIL (Kurdistan 24) – The Kurdistan Regional Government’s (KRG) representative in Baghdad announced that a Kurdish delegation would begin its visit to Baghdad on Tuesday to discuss a number of often-contentious issues with the federal government, including the budget the upcoming national census.  

“The Kurdistan Region wants to resolve all its differences with Baghdad,” Fares Isa told Kurdistan 24 in an interview on Sunday. 


The plan for the officials to travel to the nation’s capital to meet with their counterparts in the federal government was decided at a meeting of the regional cabinet on Thursday, but a date had not yet been specified.

“The KRG agreed to send a delegation to Baghdad to ensure the Kurdistan Region’s interests are represented in the 2020 Iraqi budget,” read a government statement released on Wednesday. 


During a press conference that day, KRG spokesperson Jotyar Adil said the Kurdish delegation would “initiate talks and exchange information regarding [Iraq’s] budget bill” with Iraq’s Ministry of Finance. 

 
The central government in Baghdad and the KRG have long been at odds over the budget since the fall of Saddam Hussein’s regime in 2003. In the budget passed last year, the Kurdistan Region received only 13 percent of the national share, almost a third less than the 17 percent it had been allotted in previous years. 


Ties between the two have improved significantly since the beginning of 2019, with the formation of a new federal government headed by Iraqi Prime Minister Adil Abdul Mahdi. Diplomacy between the two had reached an all-time low in the aftermath of the Kurdistan Region’s historic independence referendum in September 2017. 


Another controversial issue between the two governments is the planned upcoming census, also scheduled for 2020. 

 
Iraq’s last census was held in 1997 and did not include the Kurdistan Region. More recent counts generally estimate population based on statistics provided by the national food ration program and have often been incomplete in disputed territories.

  
A full accounting of regional populations is crucial for planning and budgeting in any nation. In Iraq, where mass displacement and campaigns of ethnic cleansing have been endemic to conflict for decades, such a survey takes on political significance.

President of the Council of Representatives Mohammed Halbousi, on Thursday, the President of the Kurdistan Democratic Party, Mr. Massoud Barzani, during an official visit to the Kurdistan region to meet a number of officials.

The meeting discussed the political, economic and security situation in the country and the latest regional and international developments. The two sides expressed their concern about the situation and tensions in the region, and stressed the need for calm and avoid conflict to maintain stability.

He called on the Speaker to strengthen the relationship between the region and the federal government in order to achieve national partnerships and enhance the stability and sovereignty of Iraq, pointing out that the controversial points can be addressed in accordance with the Constitution and constructive dialogue and partnership between all components of the Iraqi people.

ERBIL — Reaching an agreement to settle the disputes between the Kurdistan Regional Government (KRG) and the Federal Government of Iraq would serve the interests of all the people in the country, said Prime Minister Masrour Barzani.

He made the remark during a meeting with a visiting US delegation led by Chief of Office of Security Cooperation – Iraq, Brigadier General Gregory Kreuder.

PM Barzani thanked the US and the Coalition state members for their support to the Kurdistan Region to defeat the Islamic State (IS). He also described the military coordinations between Erbil and Baghdad to eradicate the IS threats as “good”.

Concerning the relations between Erbil and Baghdad, PM Barzani explained that negotiations are ongoing to find a solution to the remaining disputes, which will serve the interests of all Iraqis.
