[rtl]Since the beginning of the second legislative term (March 9, 2019), the Iraqi Council of Representatives has focused on the legislation of laws that were sent by the Iraqi government after making the necessary amendments or the laws that were removed from the previous sessions of the House of Representatives.[/rtl]
[rtl]The most important laws enacted by the House of Representatives are the re-enactment of the Ministry of Defense and Internal Service, the Industrial Cities Act,[/rtl]
[rtl]the Public Traffic Law, the Spyker Martyrs Act and a number of other laws.[/rtl]



[rtl]Constitutional and legal violation[/rtl]



[rtl]But the legislation such a number of laws may be contrary to the Constitution and the rules of procedure of Parliament, which means that the Iraqi Council of Representatives committed a violation of constitutional and legal, calling for the veto of these laws initiated by the House of Representatives.[/rtl]

BAGHDAD - The Secretary-General of the Iraqi National Congress Party, MP Aras Habib Karim, said on Saturday that the phenomenon of the leadership of the state by proxy over the past years has been one of the serious mistakes that everyone has colluded with.

"Parliament has committed itself to ending this phenomenon by the end of next June, which is a necessary obligation in order to continue to behave in the wrong and twisted ways in the management of government institutions, all of which are directly related to the interests of citizens," Karim said in a statement received by Al-Akhbar.

"The work so far on this road does not rise to the level of ambition and therefore must be attentive and move fast so as not to reach a dead end."

Legal frameworks
For his part, MP from the alliance of victory Alaa Sukar Aldalfi, that «the government and through its program committed itself to end this file», indicating that «all political blocs aspire to end the file of special grades in accordance with legal and constitutional frameworks».

State institutions

The Council voted on the draft law amending the fines law contained in the Penal Code No. (111) of 1969 amending and other special laws No. (6) of 2008 submitted by the Legal Committee in order to amend the fines amounts stipulated in the Penal Code mentioned above and to complete this amendment to the penalties stipulated in other laws And to eliminate disparity by increasing the amounts of fines contained therein.
In another matter, the Presidency of the Council postponed reading the report and discussion of the draft law on the rights of martyrs of the air base crime submitted by the Committees of Martyrs, Victims, Political Prisoners and Human Rights, to Wednesday for the purpose of maturing.
The council ended the reading of a report and discussion of the proposed law to restore the employees of the Ministries of Interior and Defense to the service provided by the Security and Defense Committee.

He urged the Health and Environment Committee to host the Minister of Health and the Supreme Environment Committee to discuss the issue of environmental pollution in the province of Basra, calling for the formation of a joint committee comprising members of the committees of health, environment, oil, energy, security, defense and agriculture to discuss the issue of pollution.

The Council postponed reading a report on the reality of the electrical system to future sessions at the request of the Committee on Oil and Energy.
It was then decided to adjourn the meeting until Tuesday, 21/5/2019.

The House voted in its 21st session held under the chairmanship of Mr. Mohamed Halboussi, the President of the Council on Thursday, 23/5/2019 in the presence of 194 deputies on the Financial Management Law and ended the first reading of the first amendment to the law of provincial and district elections.
At the beginning of the session, the Council agreed to allow the representation of the Christian, Azadeen, Shabak, Sabean Mandaean and Kurdish factions in the Committee of Martyrs, Victims and Political Prisoners in addition to their work in their main committees.
The Council voted during the session chaired by the First Vice-President of the Council, Mr. Hassan Al-Kaabi, on the draft financial management law submitted by the Finance Committee in order to regulate the rules and procedures governing the financial and accounting management in the field of planning, preparation, implementation, All federal revenues to the public treasury to cover public expenditure and determine the link between the internal control units in terms of administrative and technical mechanisms and the implementation of budgets and committed each implementing party and determine the responsibility of the Ministry of Finance over (Budget transparency, budget comprehensiveness, budget unit and budget year) in the preparation and implementation of the federal budget and related matters, in order to achieve macroeconomic stability and financial stability and enhance the allocation of the budget. resources
For his part, praised the President of the House of Representatives on the Chairman and members of the Finance Committee for their great efforts and hard work for long periods in order to complete the important law has not been legislated during the previous sessions.
The MP Haitham al-Jubouri, Chairman of the Finance Committee, thanked the ladies and gentlemen of the deputies and the members of the committee, which held more than 23 meetings, as well as hosting hundreds of experts, civil society organizations and some international organizations in order to mature the law.
On the other hand, Mr. Halboussi presented the committees concerned with the introduction of the Civil Service Law and the Federal Court Law in the coming sessions. He called on the Legal Committee to expedite the legislative procedures of the Federal Court Law, taking into consideration the decision of the Court to revoke one of the articles.
The Council ended the first reading of the draft law of the first amendment to the Law of Provincial and District Elections No. 12 of 2018 submitted by the legal committees and regions and governorates not organized in the province in order to reduce the requirement of age in the candidate for elections and to ensure a fair distribution of seats between the lists and to balance the right of the member of the winning list to withdraw from the list and The right of the list to which it belongs, in its stability as a single list and to ensure that this does not affect the formation of the local government.
Mr. Sattar Jabbar Abbas was sworn in as a member of the House of Representatives instead of MP Ajyal Karim after the Federal Court reversed the decision of the House of Representatives based on the objection submitted by Mr. Starr Jabbar and his replacement Ajyal Karim for membership of the Council for the province of Dhi Qar.
The meeting was then adjourned.

The Parliamentary Services and Reconstruction Committee headed by MP Abbas Al-Attafi and members of its members on Thursday, 23/5/2019, held a meeting to discuss the law of housing abuses.


The meeting discussed the lifting of the law on housing abuses for the first reading and its inclusion in the next sessions of the Council, as well as studying the books received by the Security and Defense Committee on the law of informatics crimes and addressing parliamentary committees to coordinate and communicate to send notes on laws of common jurisdiction.


The committee also decided to host the Media and Communications Authority and representatives of the intelligence service, as well as holding a workshop involving the directorates of municipalities in the provinces and other workshops on informatics and communications.

A member of the parliamentary legal committee Hussein al-Aqabi, Saturday, that the failure to resolve the remaining ministries before the end of June this year will not affect its work, noting that the ministries and government positions sovereign governing the work of the Constitution and not the budget.


Al-Aqabi said in an interview with Alsumaria News that "the government must abide by what committed itself to resolve the special grades and agencies before the end of June," noting that "we can not disable the interests of the citizen and the work of the Iraqi state and we have to assess and complete the equation of state building, National benefits not belonging to a particular party ".





Al-Aqabi added that "the positions are three categories, the first of which are the purely technical positions, which are subject to the job peace and specialization of work, others subject to the powers of the Council of Ministers and the third section is subject to the authority of the House of Representatives." 

He explained that "the administration of the ministries in the proxy is not subject to the decision in the budget to end the administration by proxy for the special grades before the end of June, so there is no constitutional vacuum in the case of non-resolved before the scheduled date of the positions and grades special," noting that "the linkage between the resolution of executive positions and positions Other government is not true that government positions are sovereign positions regulated by the Constitution, but the federal budget law is not interested in organizing.


The parliamentary speaker Khadija Ali said, on May 13, 2019, that the government will enter a constitutional vacuum with four ministries if the cabinet is not completed in June.

The Cabinet held its regular Sunday, which was scheduled to be held next Tuesday, but it was submitted to coincide with the holiday of Eid al-Fitr. 

The media of the Council of Ministers in a brief notice, seen by "Al-Ghad Press", said that the Council "held its regular session under the chairmanship of Prime Minister Adel Abdul Mahdi."

An official source revealed that the political movement to resolve the high positions in the government,

while noting that the government has only 30 days to resolve it.


"There has been an intensive movement that has been going on for days among the main political forces to agree on the outline of the criteria for selecting qualified persons to hold senior positions in the Iraqi state," the source said.





He added that "the political forces that won the elections and did not get the ministries demanding compensation by the positions of special grades," noting that "this demand did not satisfy all the winning parties, especially those who got their share of the ministries." 

The source added that "most ministries and independent bodies are still lagging in the issue of submitting candidates for senior positions, with the exception of the Ministry of Higher Education, which began to change the number of directors and university presidents."


As of last Sunday, the Minister of Higher Education and Scientific Research Qusay al-Suhail decided to exempt the heads of 12 universities, namely Mosul, Nineveh, Kirkuk, Tikrit, Mustansiriya, Takhtir, Baghdad, Babil, Wasit, Dhi Qar, Maysan and Qadisiya. 

It is noteworthy that the special grades in Iraq include agents of ministers, heads of independent bodies, officials of the offices of endowments, directors-general, university presidents, and any other position requires the approval of the Prime Minister after the names of ministers and officials concerned.

The Council of Ministers held its regular session on Sunday under the chairmanship of Prime Minister Adel Abdul Mahdi. The Council discussed a number of developments and the development of the electrical system and the issues prepared for the agenda, and issued several resolutions, including: the approval of the Council to authorize the Governor of Kirkuk to approve the draft projects Kirkuk investment province for 2019.
A statement issued by the council said that "the draft system of establishing the foundations and the amount of compensation and reward for those covered by the provisions of the Law for the Protection of Witnesses, Experts, Detainees and Rescuers No. 58 of 2017 was approved and agreed to solve the strategic problems by relying on the national staff of the Ministry of Higher Education and Scientific Research."
He added that he "approved the draft law of accession of the Republic of Iraq to the International Convention on Civil Liability for Oil Pollution Damage for 1992 and approved the draft law of the third amendment to the law of implementation of irrigation projects No. (138) for the year 1971".
The Council of Ministers also decided to amend the provisions of the implementation of the Federal Budget Law for the fiscal year 2019 on the competence of the competent minister and the head of the non-associated ministry in the award of goods and services. The Council also decided to change the name of the gas filling company to become a gas filling and services company.

I wonder who will be pm again. btw way hablusi stated he has the cabinet done but did not release names. so things are getting to be interesting. maybe this coming sat or the next or the next but things will happen

BAGHDAD / Al-Ghad Press: 

revealed a source familiar with, on Saturday, that the Prime Minister Adel Abdul-Mahdi told the political blocs to complete his cabinet, noting that there are two names are closest to the Ministry of Defense. 

"The Prime Minister, Adel Abdul Mahdi, told the Shiite and Sunni political blocs that he wants to complete his ministerial booth in the next sessions of the House of Representatives," the source said. "Abdul Mahdi told them they agreed on the names of the candidates and I will come to you."




The source added that "Abdul-Mahdi called the blocks to resolve the issue of candidates for education and displaced and justice and the interior and defense and told them the need to lift the veto on some of the names nominated for what remains in the ministerial cabin." 

He added that "the Ministry of Defense confined between the National Coalition and the Axis alliance," pointing out that "there are 12 candidates for defense and closest to the consensus is Salim al-Jubouri or Major General Hashim Darraji."

Former Deputy Prime Minister Bahaa al-Araji revealed on Sunday why Prime Minister Adel Abdul-Mahdi will resign from office. 

"The news that was circulated during the last few days about the resignation of Prime Minister Adel Abdul Mahdi, although not genuine, but not far from it," Araji said in a statement received by Mawazine News. 

He said that "Abdul-Mahdi believes in building a state institutions, but the political partners did not give him full freedom to start the process of construction and correct the mistakes of previous stages because of quotas and acquisitions."

Al-Araji added: "If the blocs do not cooperate with him to complete the cabinet cabin and provide professional candidates qualified for the special grades and independent bodies, he will initiate the submission of candidates before him, and his resignation will be ready when there is any block from any block, He is not one of those who are stuck in office. "

A member of the Monitoring Committee on the implementation of the government program and strategic planning, Anam Khuzai, Sunday, the Council of Ministers to publish all the work reports completed within the government program urgently.
Khuzai said in a statement received by the "Iraqi position", "The government program (2018-2022) to translate the ministerial platform to detailed plans timelines and performance indicators are clear, and participated in the preparation of ministries and stakeholders, to be a contract and a pledge committed by ministers to citizens in the performance Duties and responsibilities ".
She added that "one of the tools of the House of Representatives through which his job is to monitor the performance of the executive authority, as well as the legislative function in the issuance of laws to facilitate the implementation of this program, to serve citizens and meet their legitimate needs, and improve the standard of services and living.
Khuzai explained that "the government program included five main axes are the completion of the foundations of the federal state and its democratic republican parliamentary system, the rule of law and strengthening internal and external security, and optimal investment of energy and water resources and strengthen the economy, services and community development.
She noted that " the five axes composed of 195 executive paragraph, including the development of detailed plans Ptoukitat time, and performance indicators are clear and measurable, the adoption of a form prepared by the General Secretariat of the Council of Ministers.".
"What is surprising is the lack of publication and publication of quarterly and monthly reports of government performance, the extent of its implementation of the government program and what has already been achieved within the time limits set by the program."
She pointed out that "failure to disclose reports of achievement within the agreed time is a weak point, may impede the completion of the government program, and deprive the Council of Representatives the right to follow up the implementation of paragraphs of the government program, and diagnose deviations between the completed and planned.
"I ask the cabinet to disclose and publish all the work reports carried out within the government program in an expeditious manner so that the people's deputies, especially the committee monitoring the implementation of the government program and strategic planning, can match the government statement with the actual achievements," she said.
