The Federal Court responds to the Governor and the President of the Council of Kirkuk against Abadi on article 140

BAGHDAD / Al-Ghad Press: 

Federal Supreme Court, the case of the governor and the President of the Council of Kirkuk against former Prime Minister Haider Abadi on article 140.

According to the document obtained by Al-Ghad Press, on Wednesday, issued by the court, "The prosecutor's agent in the Federal Supreme Court (48 / Federal / 2018) claimed that article 140 of the Constitution, which is an extension of article ( 28) of the Transitional Administrative Law of Iraq states that all its requirements must be implemented within two years, which ended with the storming of the building and its council and the seizure of it by its members, as well as on the whole of the province and have committed crimes against civilians and their properties and led to the displacement of a large proportion of its components from the Kurds Arabs and Turkmen to the provinces of William Kurdistan, fearing for their lives and the lives of their families or pursue them because of their ethnicity and their political views, and these measures were in violation of constitutional and Rag materials (9,15,37 132, 140 of the Constitution and in violation of Article 140 of the Constitution. "

"It was decided at the scrutiny and deliberation unconstitutional decision taken by the defendant in addition to his function using the Iraqi armed forces and popular mobilization forces and military operations carried out by order throughout the province of Kirkuk and the cancellation of the consequences and the implementation of Article (140) of the Constitution and obligate him to restore the situation to what it was Before (16/10/2017) and allow them to exercise their normal work to manage the province, as they asked. " 

"The Federal Court considered in its last session a lawsuit challenging the events of Kirkuk during the past year and activation of Article 140 of the Constitution and the Federal Supreme Court to respond to the suit by the jurisdiction of being non-competent.
