Chapter of the Iraqi Provincial Councils in the Iraqi Constitution, Chapter II (Governorates not organized in the territory) Article (118):
1- The governorates consist of a number of districts, districts and villages.
2- The governorates that have not been organized in the region shall be granted broad administrative and financial powers, so that they may manage their affairs according to the principle of administrative decentralization, and this shall be regulated by law.
3. The Governor elected by the Governorate Council, the Chief Executive Officer of the Governorate, shall exercise the powers vested in him by the Council.
4. Fourthly, the election of the Provincial Council, the Governor, and their powers shall be regulated by law.
5. The Provincial Council shall not be under the control or supervision of any Ministry or any body connected to the Ministry and shall have independent finance.
The reasons for the development of the planning and reconstruction councils for the development of the Iraqi provinces
It is clear that these councils are fully independent in carrying out their work and administrative and financial functions in the governorates. They are not subject to the government of the center or any other authority. Which left the door open for most of the members of these councils to commit financial, administrative and legal violations that harm the residents of the provinces and hinder their progress without accountability or control.
The years since the fall of the former regime have proved that the members of the Iraqi Provincial Councils failed to manage their governorates and move towards prosperity, development and the building of a sound civil society. The majority of the members of these councils lack the scientific, professional, administrative, cultural and legal qualifications and expertise, And monitoring.
Therefore, it was necessary to develop institutions or advisory bodies that include many competent and scientific and cultural expertise and administrative specialized and fair, taking on the tasks assigned to them to promote and improve the reality of the Iraqi provinces and eliminate the phenomenon of widespread financial and administrative corruption in state institutions.
The most important of these institutions are: (Planning and Development Councils for the development of the Iraqi provinces), but this may be interpreted as contrary to what is stated in the Iraqi Constitution (Chapter II / Article 118), which granted full autonomy to the provincial councils in its work, which may be difficult to implement This proposal. Therefore, it is incumbent on the House of Representatives to enact a law to introduce (the boards of planning and reconstruction to develop the Iraqi provinces) to solve this problem.

The history of Iraq (Mesopotamia) has many human civilizations throughout the ages, and it has a distinct role in its ancient history, and the first legal laws and classes of knowledge, such as science, literature, arts and architecture.
Throughout the Islamic ages, Iraq has played a prominent cultural role in building and strengthening Islamic civilization and in various knowledge, sciences, arts and cultures, but it is facing great challenges as a result of the heavy legacy of the former regime, resulting in the collapse and destruction of economic, urban, social and cultural structures. The past years, in addition to the low level of performance of state institutions, because of corruption and party quotas abhorrent and nepotism and weak oversight, and ignoring the role of science and the qualifications and scientific expertise, professional, cultural, administrative and law And the indifference of many Iraqi scientific and cultural expertise and organizations to contribute to the building, development and development of the country, as well as the failure to address the social, health, service, humanitarian and environmental problems that require intensive efforts from various Iraqi institutions,
In view of the size of the urban, economic, cultural and tourism projects, which are related to the development and development of the Iraqi governorates, which will be assigned to the government departments and institutions for their future implementation, they in turn lack the specialized professional, scientific and administrative staff. Therefore, there must be a future vision for the development of highly efficient institutions in the Iraqi governorates Which is based on the issue of reconstruction and reform, in the light of Iraq's human and material resources, which enable it to carry out these tasks in the shortest time possible, and works side by side with government departments and institutions Of civil society organizations - the organizations, institutions and centers, non-governmental organizations - to restore Iraq to its natural place among nations, and build a sophisticated civil society according to sound scientific principles, dominated by love and affection, brotherhood, tolerance and freedom of thought and respect for human rights. The most important of these institutions are: «Councils of Planning and Reconstruction for the development of the Iraqi provinces».
These councils include a group of intellectuals, knowledge, scientific, professional, administrative and cultural expertise specialized and fair.

Plan of Action for Planning and Reconstruction Councils

1- The planning and reconstruction councils shall be responsible for the development of plans and studies of vital projects for the improvement, development and organization of cities, towns, villages, rural, urban, historical, religious and tourist sites.
2 - Cooperation and coordination among the boards of reconstruction and development of the Iraqi provinces, through the holding of conferences and seminars and periodic meetings, and under the supervision of the Supreme Council for Reconstruction and Development.
3 - Cooperation and coordination in the fields of studies, research and technology with Iraqi universities and scientific research centers and institutions inside and outside Iraq, and benefit from the expertise existing in those countries, and to see the latest scientific developments and techniques applied in order to promote and improve the status of Iraqi provinces.
4 - Adoption of advanced administrative systems and the use of modern techniques in management, planning and studies.
5 - To adopt integrity, competence and scientific, professional and cultural expertise in entrusting administrative, technical and cultural responsibilities in these councils and away from party, sectarian and sectarian affiliations.
6- To seek to call upon the competent and competent Iraqi scientific capacities to benefit from their expertise and to contribute through the planning and reconstruction councils to develop the Iraqi provinces and state institutions, to hold seminars and conferences and to benefit from researches and studies that serve the ages and development process and to disseminate them in all available means.
7 - Issuing a monthly or quarterly magazine issued by the planning and reconstruction councils for the development of the provinces, in addition to the establishment of a special website of the boards of planning and reconstruction on the Internet.

Mechanism for the formation of the Supreme Council for Planning and Reconstruction and planning and reconstruction councils for the development of Iraqi provinces

The formation of an independent advisory body headed by the Prime Minister, whose members are chosen from among the recognized with competence and scientific and cultural expertise and integrity, and ends its work after selecting the members of the Supreme Council for Planning and Reconstruction according to the following conditions:
1- Holds a master's or doctorate degree in one of the required majors.
2 - Practical experience of not less than 15 years in the field of competence.
3 - fluent in one language or more in addition to the mother tongue.
4 - Good conduct and is not sentenced to a crime against honor.
5. Participate in social, cultural or humanitarian activities and be a recognized scientific and cultural figure at the country level.
6 - Prefer who has research, studies and publications in the field of competence.
7. Participated in local, regional or international seminars and conferences.
The members of the boards of planning and reconstruction for the development of the Iraqi provinces are selected by the Supreme Council for Planning and Reconstruction headed by the Prime Minister under the following conditions:
1- Holds a bachelor's degree or higher in one of the required competencies in the development and development councils.
2 - Experience of not less than 15 years in the field of competence.
3 - fluent in one language or more in addition to the mother tongue.
4 - Good conduct and is not sentenced to a crime against honor.
5. Participate in social, humanitarian or cultural activities and be a recognized scientific and cultural figure at the governorate level.

Planning and reconstruction councils in the Kurdistan Region

The Supreme Council for Planning and Reconstruction in the Kurdistan Region is chosen by an independent consultative body headed by the Head of the Government of the Region, in accordance with the conditions applicable to members of the Supreme Council for Planning and Reconstruction.
The members of the planning and reconstruction councils in the provinces of Kurdistan are selected by the Supreme Council for Planning and Reconstruction in the region under the chairmanship of the President of the Government of the Territory and according to the conditions that apply to members of the planning and reconstruction councils in the provinces.

General controls

The planning and reconstruction councils have an independent legal personality and are civilized institutions that are not subject to any political orientation.
The planning and reconstruction councils shall be formed by a law enacted by the House of Representatives.
Objectives of the planning and reconstruction councils for the development of the Iraqi provinces and summarized in the following areas:

I. Urbanization and services

1. Eliminating the negative effects of the former regime, as a result of its neglect and destruction, and its indifference to many public utilities, especially in the field of services such as water, electricity, sanitation projects and other vital facilities such as roads, parks, children's playgrounds, youth and sports clubs and scientific and cultural centers.
2 - Prepare plans and studies to provide housing (houses and apartments) comfortable and appropriate and appropriate to the general nature of the architecture of Iraq to the largest number of sectors of society, especially poor families and low-income, and distribute them fairly, and according to the population ratios of the provinces and follow-up implementation and completion as soon as possible, And coordination with relevant institutions and departments. And the establishment of civic centers for all neighborhoods in the Iraqi provinces.
3 - Call for the contribution of the people of the Iraqi provinces and encourage them in the implementation of construction projects, tourism, economic, industrial and agricultural to achieve returns to benefit them, and in cooperation with relevant institutions.
4 - Cooperation and coordination with relevant departments and institutions to establish new markets and develop and improve the old markets and commercial areas in the Iraqi provinces, which will contribute to the reception of many visitors and tourists as well as in the development of the national economy.

II. Economic and financial

1. Encourage and support medium- and small-scale economic projects and provide the necessary loans on concessional terms.
2. Adopting the policies and legislations necessary to provide the appropriate climate to attract local, regional and foreign investments.
3. To support and encourage tourism institutions and organizations and coordinate with them in order to promote and improve tourism in the Iraqi provinces and to prepare professional and efficient professional staff to manage them, work on developing and improving them and establishing new tourism projects, especially in the field of religious tourism. Of the Iraqi society, in addition to its important cultural and social benefits, and provide all the necessary service requirements for visitors and tourists, and dealing with them in a civilized way that reflects the authentic Iraqi cultural identity.
4. Coordination and cooperation with the competent authorities to review the laws and regulations governing economic and tourism activity and to introduce new laws that are flexible and keep abreast of future developments in this regard and to work to support the private sector by reducing taxes to a minimum.
5 - Emphasize the establishment of advanced industries that rely on the natural resources available in the Iraqi provinces, to achieve self-sufficiency, especially in the building materials and materials related to petrochemicals and others to reduce the import and to protect the local product.
6 - Cooperation and coordination with the industrial departments and institutions in order to encourage and support local industries in the Iraqi provinces because of their important economic return to the country and to members of society.
7 - Prepare plans for the establishment of specialized companies in agricultural production and development in the Iraqi provinces and the preparation of research and studies for the development of this sector and relying on expertise and competencies in this area, and choose the method of participation with international companies specialized to benefit from their expertise.
8 - Call on banks and investment banks to support and encourage the establishment of economic and tourism projects in the Iraqi provinces and provide all banking facilities, through the reduction of interest rates on long-term economic and tourism loans.

III. Health and environment

1 - Provide health care to members of the community, especially in villages and rural areas through the establishment of health centers and specialized hospitals in all Iraqi provinces.
2- To cooperate with the governmental departments and environmental institutions in the Iraqi governorates and work to protect the environment and control the environmental pollution by removing waste and industrial wastes and treating them because of their negative impact on public health and spreading environmental cultural awareness through the various media.

IV. Social and humanitarian

1 - The planning and reconstruction councils for the development of the Iraqi provinces will contribute to the provision of employment opportunities and the restoration of security and stability in all governorates through cooperation and coordination with civil society institutions and government departments.
2. Work on the establishment and development of humanitarian institutions and centers, such as centers for the elderly, the disabled, orphanages, family protection and maternity and childhood care in all Iraqi governorates.
3 - Support and encourage the establishment of popular councils and cultural and social centers and forums in all Iraqi provinces and provide the necessary assistance for their activities.
4 - Establishing sports and cultural centers and clubs to improve the youth and reach the aspiration of all in the future Iraq.

V. Culture and heritage

1- To highlight the civilizational and humanitarian role of the various Iraqi cities by showing the bright aspects and cultural and national diversity and exploiting this richness through the establishment of cultural, social, artistic and sports festivals and seminars, and organizing marketing exhibitions and activating the cultural and tourism exchange between the Iraqi cities.
2. Cooperating with cultural and educational institutions to establish and develop public libraries, cultural, social and charitable centers and other civil society institutions in all Iraqi provinces, support and encourage them to play an important role in building the new Iraq.
3 - Preserving the cultural treasures in the Iraqi provinces through strict control of archaeological sites, and continue the exploration operations, and the quest for the establishment of several museums that will include these treasures as well as traditional products of industries and handicrafts and works that specialize in artists in the provinces.
4 - Cooperation with cultural circles and institutions in order to develop incentives to encourage the people of Iraqi provinces to participate in the preservation and improvement of their cities and the definition of history and civilization, and the allocation of annual prizes to support the efforts of artists and artists in the field of all arts.
5 - Cooperation with the departments and institutions and heritage and governmental institutions in order to preserve the identity of Iraqi architecture and artistic and aesthetic values ​​of the physical monuments and historical buildings and heritage in the Iraqi provinces and the maintenance and restoration of the fallout and disclosure periodically.
6. Documenting all historical and heritage buildings, taking photographs of them and making all necessary drawings for them in order to benefit from them in the future when they are repaired, maintained and reconstructed.
7- Cooperate and coordinate with the competent authorities in order to establish institutes and crafts centers for the national and Islamic heritage in the Iraqi provinces and develop the traditional crafts related to them. It will train and provide specialized hands in the Iraqi and Islamic arts in particular and all kinds. to her.
