Iraq Announces End of UN Sanctions

TEHRAN (Tasnim) - Iraq on Saturday announced the end of UN sanctions imposed on the country following its invasion of neighboring Kuwait in 1990.
In a statement, the Iraqi Foreign Ministry attributed the abolishment of the UN sanctions after 27 years in place to “diplomatic successes”, Anadolu Agency reported.
This decision “is an important step in the restoration of Iraq’s natural status and international standing,” ministry spokesman Ahmed Mahjoub said.
The UN Security Council imposed the sanctions on Iraq under Chapter VII and created the oil-for-food program, which allowed the former regime of Saddam Hussein to sell oil in the world market for buying humanitarian needs of its citizens.
Speaking to Anadolu Agency, Iraqi legal expert Tarek Harb said Iraq was effectively removed from under Chapter VII sanctions four years ago.
At the time, he said, Iraq owed $4.6 billion to Kuwait in the form of investments and gas shipments.

All Measures Imposed under Iraq Oil-for-Food Programme Implemented in Full, Security Council Concludes, Unanimously Adopting Resolution 2390 (2017)
The Security Council concluded today that all the measures imposed in its resolutions 1958 (2010) and 2335 (2016) pursuant to Chapter VII of the Charter of the United Nations in relation to the Iraq oil-for-food programme had been fully implemented.
Unanimously adopting resolution 2390 (2017), the Council welcomed the fact that the remaining funds in the escrow accounts established pursuant to resolution 1958 (2010) had been transferred to the Government of Iraq pursuant to resolution 2335 (2016).
The Council acknowledged the Secretary-General’s final report on the matter (document S/2017/820), which stated, among other things, that the remaining $14,283,565 in the administrative escrow account had been transferred to Iraq.
Following the adoption, Amy Noel Tachco (United States) applauded Iraq’s complete implementation of measures under the oil-for-food programme, although the country still faced many challenges. She looked forward to close cooperation internationally and bilaterally in support of Iraq as a federal, democratic and prosperous country.
The meeting started at 9:45 a.m. and ended at 9:48 a.m.

The full text of resolution 2390 (2017) reads as follows:
“The Security Council,
“Recalling its resolutions 1958 (2010) and 2335 (2016),
“Acknowledging receipt of the final report of the Secretary-General pursuant to paragraph 4 of Security Council resolution 2335 (2016), S/2017/820,
“1. Welcomes the implementing arrangements entered into by the Secretary-General and the Government of Iraq as requested in paragraph 7 of Security Council resolution 1958 (2010);
“2. Also welcomes that the remaining funds in the escrow accounts established pursuant to paragraphs 3–5 of Security Council resolution 1958 (2010) have been transferred to the Government of Iraq pursuant to Security Council resolution 2335 (2016);
“3. Concludes that all the measures imposed by the Security Council in resolutions 1958 (2010) and 2335 (2016) pursuant to Chapter VII of the Charter of the United Nations have been fully implemented by the parties.”

The agency publishes Alsumaria News, the text of the Security Council resolution issued on the exit of Iraq from Chapter VII.
A spokesman for the Ministry of Foreign Affairs Ahmed Mahjoub said in a statement received Alsumaria News, a copy of it that " the Security Council issued a decision to exit Iraq from Chapter VII of the oil - for - food program, and restore it to its natural position and international status."
"This came after a series of diplomatic successes achieved by the Foreign Ministry," Mahjoub said, adding that "Iraq has completed all the obligations of the program."
On March 30, 2017, Prime Minister Haidar Abadi stressed the existence of continuous work in cooperation with the United Nations to close the file of Chapter VII, noting that his government supports the international efforts to hunt down and punish the "terrorists". UN Secretary-General Antonio Guterres appealed to the international community To assist Iraq in the relief of displaced persons and the reconstruction of liberated areas.
On October 23, 2012, the Iraqi Foreign Ministry announced that the Emir of the State of Kuwait had agreed to settle the issue of Kuwait Airways' compensation resulting from the Iraq war, while confirming that Kuwait had informed the law firms in Britain to stop all claims on Iraqi Airlines and properties.
The Iraqi-Kuwaiti relations have recently seen progress in resolving some of the outstanding problems. The two sides agreed during the visit of former Prime Minister Nuri al-Maliki to Kuwait in March 2012 to end the issue of compensation related to Kuwait Airways and the maintenance of border signs. Foundations and common frameworks for solving all files, within short time tables.
Kuwait has demanded that Iraq pay $ 1.2 billion in compensation for the seizure of 17 aircraft owned by Kuwait Airways since 1990. The file has led to political problems between Iraq and Kuwait after the latter sued Iraqi Airways for freezing assets in Jordan and Britain. In 2010, which led to the decision of the Iraqi Council of Ministers in May of the same year, the liquidation and cancellation of the company and offered to sell to private companies, and also decided to cancel all associated administrative formations, while retaining the cadre after the sale to a private company.
Iraq has been subject to Chapter VII of the Charter of the United Nations imposed after the invasion of the regime of former President Saddam Hussein, the State of Kuwait in August of the same year, and allows the item to use force against Iraq as a threat to international security, in addition to freezing large amounts of Its financial assets in international banks to pay compensation to those affected by the invasion.

Means they paid off Kuwait, and has no significance beyond that, though the pooroos have been using it in their hype. The reality is they have for all intents and purposes been released from Chapter VII for several years as all of the other requirements had been satisfied and all restrictions lifted. Only the escrow fund remained.
